Any party may refer a dispute about an alleged unfair labour practice in writing to-
a council, if the parties to the dispute fall within the registered scope of that council; or
The party who refers the dispute must satisfy the council or the Commission that a copy of the referral has been served on all the other parties to the dispute.
The council or the Commission must attempt to resolve the dispute through conciliation.
If the dispute remains unresolved-
any party to the dispute, if the dispute is about an act or omission referred to in item 2(1)(a), may refer the dispute to the Labour Court for adjudication;
any party to the dispute, if the dispute is about an act or omission referred to in item 2(1)(b), (c) or (d), may request that the dispute be resolved through arbitration.
