If the employer operates more than one workplace and separate workplace forums have been established in two or more of those workplaces, and if a matter has been referred to arbitration in terms of section 86(4)(a) or (b), or by a workplace forum in terms of section 87(4), the employer may give notice in writing to the chairpersons of all the workplace forums that no other workplace forum may refer a matter that is substantially the same as the matter referred to arbitration.
If the employer gives notice in terms of subsection (1)-
each workplace forum is entitled to make representations and participate in the arbitration proceedings; and
the arbitration award is binding on the employer and the employees in each workplace.
