Schedule 5 Suspension and Variation of Application of Occupational Diseases in Mines and Works Act, 1973 (Act No. 78 of 1973)

A: Suspension of Application of Act No. 78 of 1973

The application of the following sections of the Occupational Diseases in Mines and Works Act, 1973 (in this Schedule referred to as the 1973 Act) is hereby suspended:

1. Section 4(2)(b).
2. Section 15.
3. Section 16(1)(b) and (c).
4. Section 23.
5. Section 24.
6. Section 25.
7. Section 26.
8. Section 27(2), (3), (4) and (5).
9. Section 28.
10. Section 29.
11. Section 30.
12. Section 37(2)(a).
13. Section 121(1)(b), (h) and (i).
14. Section 124(3)(g) and (h).
15. Section 125.
16. Section 126(1), (2)(a) and (b) and (3)(a) and (b)(i).

B: Variation of Application of Act No. 78 of 1973

1) The application of the following sections of the 1973 Act is hereby limited to medical examinations for the purposes of determining benefits:

1. Section 4(1) and (2)(a).
2. Section 5.
3. Section 31(1).
4. Section 36, subject to item 3(b).
5. Section 37(1), (2)(b) and (3).

2) The application of section 27(1) of the 1973 Act is hereby limited to instances where the director receives a communication as contemplated in section 33(1).

3) The application of the following sections of the 1973 Act is hereby limited to persons employed at mines or works:

1. Section 31(1).
2. Section 36(1)(a).
